Where the 2016 Presidential Candidates Stand on Marijuana Legalization.

If you own a cannabis-based business or work in the recreational marijuana industry, there's a big reason besides politics to start paying attention to the 2016 Presidential race. Depending on who gets elected and how much our new President's influence is able to sway the direction of U.S. Policy, your very livelihood could be at stake. While it's never clear what a candidate's actual policies will be once they get into office, the things they've said in the past can indeed provide strong indications.

The Marijuana Policy Project website provides an evaluation of such indications, and their ratings provide cause for alarm. Only one viable candidate received a grade “A” on their policy regarding legalized marijuana—Bernie Sanders. Meanwhile, Hillary Clinton scored a “B,” Donald Trump a mediocre “C+,” and Marco Rubio an even lower grade of “D.”

To help you evaluate these candidates for yourself, we've compiled a sampling of relevant quotes from these politicians and their campaigns. Take a look, and if anything concerns you, be sure to do further research so that you can be sure to know who (and for what) you are voting for.

Marco Rubio: If one thing positive can be said about Marco Rubio's position on legal cannabis, it's that at least he makes his stance on the issue very clear. When he was a guest on the Hugh Hewitt Radio Show in February 2015, he was asked if he would enforce federal law and shut down the legal recreational marijuana industry in Colorado. Rubio responded, “Yes. Yes, I think, well, I think we need to enforce our federal laws. Now do states have a right to do what they want? They don't agree with it, but they have their rights. But they don't have a right to write federal policy as well.” He goes on to explain, “I don't believe we should be in the business of legalizing additional intoxicants in this country for the primary reason that when you legalize something, what you're sending a message to young people is it can't be that bad, because if it was that bad, it wouldn't be legal.” He reiterated that view at a Meet the Press conference in August of 2015, when he was asked if he would enforce federal law in states where cannabis legal. Rubio responded, “Absolutely. I believe that the federal government needs to enforce federal law.” Earlier this year, Rubio was quoted in the Washington Times as saying, “There is no responsible way to smoke marijuana repeatedly. There's nothing good about it.”

Donald Trump:  Trump's position, however, seems to change with the times. Way back in 1990, he favored the legalization of all drugs, calling the War on Drugs a failure. But when asked at a conference last June how he felt about Colorado's legalization of cannabis, Trump stated, “I say it's bad. Medical marijuana is another thing, but I think it's bad, and I feel strongly about it.” At an event just a few months later in October, Trump had this to say: “Marijuana is such a big thing. I think medical should happen—right? Don't we agree? I think so. And then I really believe we should leave it up to the states.” He then went on to mention Colorado specifically, saying, “And of course you have Colorado. And I love Colorado and the people are great, but there's a question as to how it's all working out there, you know? That's not going exactly trouble-free. So I really think that we should study Colorado, see what's happening.”

Hillary Clinton: Meanwhile, Hillary Clinton seems generally positive about marijuana legalization at the state level, but seems hesitant to take an official position one way or another. In 2015, Clinton aired her support for legalization in Colorado, saying, “I really believe it’s important that states like Colorado lead the way, so that we can learn what works and what doesn’t work. And I would certainly not want the federal government to interfere with the legal decision made by the people of Colorado, and enforced by your elected officials, as to how you should be conducting this business that you have approved.” As a guest on WBZ Radio in January 2016, Clinton was asked about her stance on marijuana legalization and replied, “I think that states are the laboratories of democracy, and four states have already taken action to legalize, and it will be important that other states and the federal government take account of how that’s being done, what we learn from what they’re doing. I think that the states moving forward is appropriate and I think the federal government has to move to make this more available for research that they can then distribute to interested people across our country.” She went on to explain, “I do think on the federal level we need to remove marijuana from the Schedule I of drugs, move it to Schedule II, which will permit it to be the basis for medical research because it’s important that we learn as much as possible.”

Bernie Sanders: Bernie Sanders is the only candidate so far to take a clear and undeniable stance in favor of federal marijuana legalization. As a senator, Sanders introduced legislation in November 2015 that would result in marijuana being removed from the federal list of controlled substances, and allow states the power to regulate and tax marijuana if they have the desire to do so. Under Sanders's plan, cannabis-based businesses would also be ensured fair and non-discriminatory access to banking services and standard tax deductions just like any other business. According to the Bernie Sanders campaign website, “Bernie favors removing marijuana from the list of controlled substances regulated by federal law. Under Bernie’s proposal, people in states which legalize marijuana no longer would be subject to federal prosecution for using pot. Owners of stores that sell marijuana could fully participate in the banking system, like any other business.” Sanders also seems to favor reforming the way marijuana cases are handled in America's justice system, stating, “Someone in the United States is arrested every minute on marijuana charges. Too many Americans have seen their lives destroyed because they have criminal records as a result of marijuana use. That’s wrong. That has got to change.”

Why it Matters:

Currently, federal laws against marijuana cause complications for many cannabis-based business entrepreneurs in states where commercial cannabis is legal, and the federal classification of marijuana as a schedule 1 controlled substance prevents hemp production and manufacturing from being economically viable under present law. Meanwhile, more and more states are seeing voter-led ballot initiatives to make recreational cannabis legal, and states like Colorado where it is already legal are experiencing the benefits of massive profit. Whoever wins the next Presidential election will likely hold heavy sway on determining which way the tide will turn.

Prices to Rise for Oregon Weed Buyers

Oregon weed smokers will soon be paying more for recreational cannabis. Beginning January 4th, dispensaries will be required to collect a 25% tax on all recreational marijuana purchases. Recreational marijuana has been tax-free since the first retail sales began in October 2015, giving buyers a break on prices. On average, a gram of recreational flower sells for anywhere from $8 to $15 in Oregon, with quarter-ounces ranging from a low $25 to a high $150. Oregon state law limits recreational cannabis purchases to no more than a quarter-ounce in one day, so retailers are unable to offer discounts on larger quantities like buyers in Colorado enjoy. With the new taxes, what used to be an $8 gram will now cost $10, while a $60 quarter will jump up to $75. Considering that most moderate to heavy herb smokers go through substantially more than a quarter-ounce per week, that additional 25% tax per purchase could really add up.

Retail recreational marijuana sales in Oregon topped 11 million in the first month alone, so the new cannabis taxes will likely add millions to the state's annual income. The tax revenue will be split between state and local agencies, with the largest shares going to the Common School Fund and to Mental Health, Alcoholism, and Drug Services. 

Currently, recreational cannabis is sold only through medical dispensaries in Oregon, but new stand-alone recreational-only dispensaries are expected to open starting in October 2016. Sales at the new dispensaries will only be subjected to a 17% tax, with cities and counties having the option of imposing an additional 3% tax if they choose to do so.

Despite the increase in taxes and higher prices in the interim, the cost of recreational marijuana in Oregon may eventually decrease over the next few years as more dispensaries open and the market stabilizes. There is currently a lot of variation and fluctuation in Oregon cannabis prices, with dispensaries still struggling to find the right balance between costs, supply, and demand. 

What's certain is that at least until next October when the first recreational-only dispensaries open, you'll soon be paying a solid 25% more for your weed. If you're concerned about your bud budget, you might want to stock up on tax-free weed while you can, making as many purchases as the law allows between now and January 4th. Just Say No…To National Parks, Spend Labor Day Somewhere 420 Safe

Marijuana is legal in several states now, with several more sure to come in the near future.  But just because pot is legal in a state does not mean that everywhere in that state is a safe place to spark up.  Marijuana is still illegal federally, so that means that it’s still illegal on any federal land.  Now it’s pretty easy to remember that federal courthouses and military bases are federal land, but there is one kind of federal land that we all seem to forget belongs to big brother - national parks and recreational facilities.  These lands are the most fantastic examples of what America the Beautiful really means, and because of this, they are the ones we want to visit and get high at the most.  But take this word of warning from the Savvy Stoner to heart.  Do not be tempted to bring pot onto federal land this Labor Day weekend, or anytime, even if it’s dank and the cheapest weed in Denver and you’re only cutting through the park.  You could end up like tens of thousands of others who thought they could get away with it – at the police station, having no fun at all. 

So where are some alternative places to enjoy your 420 friendly getaway, read on for some ideas to get you on your way to a legal and safe Labor Day celebration that includes memories that you want to remember.

State Parks

If your vacation plans bring you to Denver, or anywhere in Colorado, or the country, then state parks may be a great alternative to national parks. Every state has their own parks that uphold state laws, so if marijuana is legal in your state, then it’s legal in the state parks too unless it’s a park rule like no glass bottles.  And the choices of scenery, location, and recreation options are usually almost limitless.  In Colorado there are 42 state parks, with facilities in just about every nook and cranny of the state.  There is probably a state park within about an hour of where you are now, even if you don’t know it.  Many state parks are fairly unknown places, making the crowds much smaller than at more highly publicized places and making it much easier to rent a cabin, yurt, or campsite to enjoy your stash.  Remember though to always check individual park rules and always be private, discreet, and polite when enjoying your weed – it’s only right.

420 Friendly Hotels and Bed & Breakfasts

Finding dispensaries, even good cheap dispensaries is pretty easy in Colorado, but that isn’t always the case when it comes to 420 friendly lodging.  Many national hotel chains still feel they must abide by federal law completely and refuse to allow 420 friendly advertising; but some do still make pot users feel right at home by providing accommodations like outdoor smoking areas to make up for the fact that marijuana smoking of any kind is not allowed in the guest rooms.  If that sounds a little too iffy, then there are pot friendly hotels and bed and breakfasts too.  420 friendly hotel rooms often come with, or have access to, bongs and vaporizers to add to your awesome Colorado marijuana experience.  If a little more homelike and cozy is what you want, then maybe the weed friendly bed and breakfast is for you.  These are just like “regular” B&B’s with one huge difference, weed!  Not only is its use encouraged, it is socially acceptable too.  These weed-centric B&B’s are usually within walking distance or so from at least one dispensary with great dispensary deals, and generally really nice places to just kick back and chill.

Private Property (with Permission)

Private property, like the kind owned by people you know, can be one of the best places to spend any holiday weekend.  Parking is usually free, the rooms are cheap, the roommates may be weird – but they’re usually related to you.  Oh, and there are usually plenty of great cheap dispensaries nearby where you can buy all the great cannabis products you need to have the best holiday weekend ever.  Edibles, wax, shatter, butter or dabs.  Whatever you call it; flower, bud, chronic or dank.  Friends and relatives’ homes or vacation property can make for the best 420 friendly vacation destinations.  Easy to book, 420 friendly, and best of all, cheap.  Your next Cannabis friendly vacation, think of your friends and family when you think of affordable and pot friendly places to stay and save your cash for great deals on $100 ounces and so much more.

How Much Weed Can You Buy In Colorado?

So you’re perhaps visiting colorful Colorado and you want to partake in as much cannabis smoking as humanly possible. We get it – with so many strains, terpenes, and types of marijuana products available, it’s like being a kid in a candy store. But how much weed can you buy in Colorado? Well, there seems to be a few set rules, but a lot of grey area around such rules. 

Let us explain. 

Weed Purchases Colorado

Buying Weed: How It Used To Be

It used to be that there were special marijuana deals you could get at marijuana dispensaries in Colorado that included an ounce of marijuana flower and a couple of grams of concentrates. These and many more of the best marijuana deals and best deals on concentrates in large quantities became a thing of the past on October 1st when new Colorado marijuana regulations went into effect that more specifically defined purchase limits by clarifying the concentrate to flower equivalency.

At the time, a gram of THC was considered a gram of THC, and tourists could only purchase up to 7 grams of it while residents in Colorado were allowed to purchase up to 28 grams of it, be it in the form of concentrates like wax and shatter, in the form of edibles, or in the form of buds. 

New(ish) Marijuana Regulations for Consumers

When the new marijuana regulations went into effect on October 1st, 2016, 800 mg of edibles or 8 grams of concentrate were considered equivalent to 28 grams of marijuana flower. One gram of concentrate is now considered equivalent to an eighth of flower, while two grams is equivalent to a quarter ounce. 

This meant that no longer would Colorado marijuana dispensaries be able to offer their retail customers anything close to an ounce of flower, paired with two grams of concentrates. 

So, now, if you purchase two grams of concentrates, the most bud you can buy is just three quarters.

Deals on whole ounces of concentrates have changed, too. The new regulations greatly diminished the quantity of concentrate purchased in a single transaction, and no longer are recreational marijuana consumers allowed to purchase more than 8 grams of concentrates at a time without exceeding the purchase limit. 

Weed Limits Colorado

And, with many edibles packing 200mg THC per package, a few marijuana-infused candy bars can add up to the 800mg purchase limit very quickly. If you want to mix and match with some flower or edibles or concentrates, you have to really be smart in tallying up exactly how much of what you can legally get. The biggest challenge that marijuana dispensaries face now is to come up with alternative bundle packages that include a carefully thought-out balance of flower and concentrates or edibles that will appeal to marijuana consumers while staying within the rules (although you will see different dispensaries offer certain bundle packages that maximize how much weed you can buy in Colorado at a time).

New(ish) Marijuana Regulations for Dispensaries

Other new(ish) regulations have affected the cannabis industry more than the marijuana consumer. Remember that weird label that comes on every marijuana product you buy in Colorado, that looked a bit like a sheriff's badge, only it said, “Department of Revenue” and “marijuana” on it? That became a thing of the past as a new marijuana warning label has since been adopted. 

The new retail marijuana symbol features a diamond shape surrounding the word “THC” coupled with an exclamation mark. Each individually wrapped edible also contains this new icon. The new symbol for medical marijuana is virtually the same, only with an additional letter “m” to denote that it is a medical product. The new universal symbols came into use on October 1st, but there was a two-month grace period extending the compliance period until November 30th, 2016. Any establishments found selling marijuana labeled with the outdated universal symbol face serious penalties.

How Much Weed Can You Buy in Colorado Now?

The simple answer of how much weed you can buy in Colorado: Colorado residents and visitors alike may purchase up to 1 ounce (Oz) of marijuana at a time, once a day. 

Medical marijuana patients are allowed up to 2 ounces (Oz) of marijuana at a time, once a day.

Now, there currently isn't any system in place that actually prevents consumers from simply heading from one dispensary to another to get around the purchase limits, but the law also says that Colorado residents and visitors alike may only POSSESS up to 1 ounce at a time, while medical marijuana patients may only POSSESS up to 2 ounces at a time. 

So, nothing’s stopping you from going from dispensary and dispensary and maxing out your pot purchase limit, but be ye warned – if you’re caught with the possession of more than an ounce at a time (given you’re not a medical marijuana patient), there may be a fee or civil penalty assessed. We don’t recommend doing this. 

Don’t think you’re wise in leaving a dispensary with the maximum weed allowed, only to return and buy more, as they’ll have record of each transaction made. An example was made out of one of Colorado’s largest dispensaries, Sweet Leaf, after being busted for working around some of the loopholes.

If you’re driving, you can have weed in your car, but it must be under the allowed limit and must be in a sealed container. It is not allowed to consume marijuana in the car or while driving. It’s also not allowed to carry marijuana across state borders. 

So, whether you’re a Colorado resident and just don’t buy weed much or you’re only visiting Colorado for a short period of time, the new laws allow you to buy a significant amount of weed. So, how much weed can you buy in Colorado? The short answer is, enough. Unless you’re smoking an ounce a day, then we have a few problems to address. If an ounce a day isn’t enough, then just come back tomorrow!

Where to smoke in Denver

You’re probably in the Denver area and are searching Google for “Places to smoke near me.” Well, you came to the right place. 

While marijuana possession is legal in Colorado, public consumption remains illegal, with violators risking tickets, fines, and having their weed confiscated. The good news is there are indeed places to smoke weed in Denver, if you know where to go, and/or you know how to be discreet and polite. Basically, the word on the street is that if there's no one around to see you, you should be relatively safe. 

While you probably don't want to risk toking up a joint in the middle of a busy city street, if you find a secluded space, a little dark corner somewhere or a hidden alcove amid some trees, or even an empty sidewalk to stroll along, as long as you're discreet and keep an eye out, you should have little to worry about. 

Discreet Marijuana Products

First off, let’s talk about a few portable pot products that you can use, that are best for outdoor areas. You don’t want to be carrying a bong around with you, nor do you want to be holding a bulky weed grinder. Here are some better options:

Pre Rolls

Pre-rolled joints, which can be purchased at any recreational marijuana dispensary are a nice choice for travelers to Denver due to their unbeatable convenience, portability, and cigarette-like appearance. 

Edibles

Edibles are virtually undetectable and can be consumed anywhere without drawing any attention. After all, you’re just eating, right? This is probably the best way to enjoy your cannabis while being outdoors.

One-hitters

Lastly, you can use something like a one-hitter or a dugout. Neither of these options draws a lot of attention as they’re easy to put away, so even if someone does smell the smoke, they’re not sure where it’s coming from.  

Places to Smoke in Denver

While we don’t condone it, we understand that you don’t always want to be enjoying your cannabis within four walls. You’re probably like so many others in Denver, Colorado – you like to enjoy the outdoors. So there are some places to enjoy the fresh air while also enjoying some fresh bud

Avoid Parks

Most parks around the Denver area attract a lot of people, a lot of homeless, and, consequently, a lot of harder drugs. Parks are a little too public and crowded to enjoy your cannabis and there really are so many other better places to smoke than in a park. You’re either going to attract a lot of unwanted attention in these areas or you’re going to annoy those who don’t partake, so don’t be “that guy.” 

Cannabis Tours

There are a few cannabis-specific tours that you can legally enjoy your weed while also seeing the sights that Denver has to offer. A lot of these tours are BYOC (bring your own cannabis), so check out a recreational dispensary before going on one of these tours.

  • City Sessions - This place offers a variety of tours, but you can expect to see Red Rocks, a few different neighborhoods, a grow facility, and a few other things. They offer private tours, so book ahead.

  • Loopr - Ride Loopr tour buses around town and experience Denver on a higher level. All sorts of tours and events are available.

  • Colorado Cannabis Tours - From classes, to karaoke, cooking and city tours, they offer it all. They even offer transportation to and from the airport!

Open Places to Smoke in Denver 

While it’s still illegal in these open areas, these places to smoke are a little more 420-friendly as you’re likely to see others doing the same or not see anyone at all. Here are the best places to smoke near the Denver area, without anyone raising an eyebrow.

  • Disc golf courses - Yes, disc golf is a great outdoor sport and if you’re not any good, it’s a great excuse to smoke out in public without drawing a lot of attention.

  • Red Rocks Amphitheatre - While they definitely come out and say you shouldn’t partake in any marijuana smoking, sometimes the safest places are amongst the masses. Just be discreet and blow your smoke downwards because there is security that goes around to watch for smoke clouds.

  • Lakes - There are a few lakes in the Denver area that provide a lot of shade and trees, as well as open space. There are likely to be other people, but chances are that you will have enough space between you and them to partake.

“Baking” Around Bars

While it's technically illegal, many bars downtown do seem to tolerate smoking on their outdoor patios, as long as patrons are discreet. The bars can't openly admit that they allow it, however, so don't create an awkward moment by asking about it. It all depends on the crowd and the place, so poke around until you smell the sweet smoke, then you'll know you're most likely in a safe space that's 420 friendly. 

If you want to get to know some friendly locals who might have further advice on where to smoke, where to stay, where to shop, or what to do for fun while you're traveling in Denver, both Sancho's Broken Arrow and Cheba Hut are downtown Denver bars known for their chill stoner crowds and laid back vibes.

When you travel to Denver, you'll find that this town is whatever you make of it. Denver is a great 420-friendly destination for the ultimate marijuana tourism adventure, but it's a lot of other things, too. 

Whether you're traveling with children and looking for family fun, traveling with friends and looking for a party, or traveling alone and looking for peace and solace, there is truly something for everybody in the Denver area. 

Whether you want to explore a museum, visit an amusement park, lounge at a coffeehouse, or dine at a great restaurant, you'll find plenty of options. However, it’s best that you partake in the pot-smoking elsewhere before getting to these places.

Is California Finally Ready for Recreational?

California was the first state to legalize medical marijuana way back in 1996, but some twenty years later still hasn’t been able to take the leap to recreational legalization until now.  Will 2016 finally be the year that Californians say yes to recreational use of marijuana?

Since 1972 voters in Cali have been trying to get pot legalized to little avail.  They started this wonderful movement we are experiencing today, but have not been able to reap the full rewards of all their hard work until now.  The election this year holds promise for many California potheads, with the inclusion of Proposition 64 on November’s statewide ballot.  Proposition 64, also known as the California Marijuana Legalization Initiative, seeks to legalize marijuana and hemp under state law and provide for the collection of certain sales and cultivation taxes.

The proposition has plenty of supporters across the state including the California Medical Association.  Sponsors began collecting petition signatures in February and had until July to collect the 365,000 signatures needed.  On May 4th sponsors announced that they had collected 600,000 signatures.  It was also announced that as of May, supporters claimed to have over $6 million in funding while the opposition reported a mere $135,000 in available funds.  Money isn’t the only show of support for the initiative either, high profile individuals have thrown their official support behind the proposition, including former Presidential hopeful, Bernie Sanders and California Lieutenant Governor, Gavin Newsom.

Proposition 64 is not without its critics however.  One major opponent is the California Hospital Association.  Not surprisingly a physician spokesperson and family practitioner, Dr. Ted Pole of Ventura, was quoted as saying, “I don't think marijuana is something that improves people's health.”

The traditional medical community is not the only group moving with caution concerning Proposition 64, there are many growers and related marijuana industry professionals who are approaching the ballot measure with great caution.  These individuals and business owners interested in starting pot related businesses like Denver’s own Colorado Cannabis Tours are concerned with the rules and regulations built into the initiative.  Rules and regulations that dictate tax collection and other standard business regulatory mumbo jumbo, but also rules that limit the formation of monopolies for 5 years in an attempt to encourage competition – rules that certain entities were hoping to keep out of Proposition 64.

Recreationally legal weed and the potentially high profits that come with it is an issue that may or may not be settled in California once and for all this November.  Maybe the initiative will pass with flying colors, or maybe it will stall and die thanks to special interest groups.  Maybe the best chance that California’s Proposition 64 has for passing is that it was named after Colorado’s own great experiment, Proposition 64.
